Punjab: High courtroom granted bail to girl accused for not informing police about sexual harassment of daughter

The Punjab and Haryana High Court has accepted the bail plea of ​​a girl who’s dealing with expenses of not informing the police concerning the alleged rape of her daughter by her husband. The FIR within the matter was registered on July 21, 2020 at PS 31, Chandigarh.

The girl, via her counsel, had argued earlier than the High Court bench that she was the mom of the sufferer and the one allegation towards her was that her husband used to sexually abuse her daughter and he or she failed to tell the police.

The petitioner was booked below Section 120-B (legal conspiracy) of the Indian Penal Code. However, the girl’s counsel mentioned, there was no allegation of prior assembly of minds of the petitioner and her husband, the allegation was leveled towards her husband.

In truth, the counsel additional mentioned, that the petitioner herself was dealing with issues from her husband, who has a disturbed psychological disposition.

The counsel for the UT replied that the petitioner was conscious of each facet of her husband’s sexual harassment of his daughter. The petitioner remained silent and didn’t inform the police on this regard regardless of repeated requests by her daughter.

The Division Bench of Justice Rajbir Sehrawat, after listening to the arguments, allowed the bail plea and ordered the discharge of the petitioner, topic to manufacturing of bail bond/bail to the satisfaction of the Duty Magistrate involved.
