Mining case: Soren writes to Election Commission, seeks copy of Governor’s second opinion

Jharkhand Chief Minister Hemant Soren has sought a replica of Governor Ramesh Bais’ request to the Election Commission (EC) to rethink its opinion on the mining matter.

Soren despatched the letter on October 31 after Bais stated in a TV interview that he had despatched the primary letter to the Election Commission for a second opinion to keep away from bias. In August, the Election Commission despatched its opinion to the governor on the potential disqualification of Soren for proudly owning a mining lease whereas he was the Mines Minister.

The governor has not made the opinion public.

The letter, despatched by the CM’s counsel, stated: “The Hon’ble Governor has not communicated his decision in the context though more than two months have elapsed since the Commission gave its opinion… (Soren) ) is now learning from the media Reports that recently, the Governor disclosed in a press interview to electronic and print media on October 27, 2022 that he has sought a second opinion from the Election Commission of India, pending before the Commission. (Soren) has not received any notice from the Commission in this regard.”

“…on behalf of my client, I request you to furnish a copy of the request for opinion received by my client from the Hon’ble Governor of Jharkhand,” the letter learn. The transfer assumes significance because the Supreme Court is prone to move an order on November 7 on a petition filed by Soren difficult the sustainability of two PILs, together with the mining lease case. The Jharkhand High Court in June handed an order saying that the petitions of shell firms and mining leases have been upheld.

The Election Commission had earlier stated that any communication between the Election Commission and the Governor is “privileged” below Article 192(2) of the Constitution and it will be “violation of constitutional propriety” to reveal it earlier than the Governor passes an order.

Meanwhile, the BJP on Sunday apologized to Jharkhand Chief Minister Hemant Soren for alleging that an Income Tax official had gone to raid the automobile offered by the opposition get together within the state.
