Petition in HC to quash Goa cupboard’s transfer permitting mineral transportation

The Goa Foundation has moved the High Court of Bombay in Goa in search of quashing of the state authorities’s cupboard resolution to permit transportation of minerals or ores even after the January 31 deadline set by the Supreme Court.

In a PIL filed earlier this month, the muse has stated that the Supreme Court had requested the state authorities to accumulate the mining land and ore leased within the state by January 31.

Under Rule 12(1)(hh) of the Mineral Concession Rules, 2016, the petitioners submitted that the Government is required to train management over the mining land. The high courtroom had given time until the tip of January this yr to clear the ore extracted between 2015-2018.

The PIL, filed via Goa Foundation Secretary Claude Alvares, stated the state authorities had “willfully ignored” the apex courtroom’s path and went out of its strategy to “illegally encourage former lessees” to pay royalty. “The Government of Goa has, in fact, taken a cabinet decision allowing such transportation of ore at the instigation of influential elements of the mining lobby. This is simply unacceptable conduct,” alleged the PIL.

The High Court on Monday adjourned the PIL until October 26 after two legal professionals sought intervention purposes on behalf of former mining lease holders.
