SC slams ED for looking for cancellation of bail of accused affected by most cancers

The Supreme Court pulled up the Enforcement Directorate (ED) for submitting a plea looking for cancellation of bail of an accused affected by most cancers, saying he mustn’t have wasted “stationery, legal fees and court time”.

A bench of Justices MR Shah and MM Sundaresh imposed a positive of Rs 1 lakh to be borne by the officer involved, who had granted permission to file the particular depart petition.

The particular depart petition is dismissed with exemplary value, which is to be borne by the officer involved, who allowed the particular depart petition of Rs 1,00,000 to be recovered from the wage of such officer.

“The cost is to be deposited with the Registry of this Court by the Department within a period of four weeks from today. On such deposit, Rs 50,000/- shall be transferred to the National Legal Services Authority, New Delhi and Rs 50,000/- to the Arbitration and Conciliation Project Committee, Supreme Court,” the bench mentioned.

The company had moved the apex courtroom towards the November 12, 2021 order of the Allahabad High Court, which had granted bail to the individual, observing that he was affected by malpractice.

The High Court had requested the involved physician of Kamala Nehru Hospital, Prayagraj to scan the applicant and submit a report on his well being standing and stage of most cancers.
