The Supreme Court has sought the Centre’s response on a plea towards the 35-year age restriction on girls’s reproductive rights to conduct pre-pregnancy and pre-natal diagnostic exams.

A bench of Justices SK Kaul and Abhay S Oka issued discover to the central authorities and others on a plea filed by a lawyer, who mentioned that the age restrict is a restriction on the reproductive rights of girls.

“She cites Section 4(3)(i) of the Pre-Conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994, to argue that the age restriction of 35 years is a restriction on girls’s reproductive rights. And in view of the current judgment of this Court…issuance of discover is proscribed to the above side,” it mentioned.

The apex courtroom was listening to a petition filed by advocate Meera Kaur Patel, who had contended that the age of 35 years underneath Section 4(3)(i) of the Pre-conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Act Ban, 1994 is a restriction on the reproductive rights of girls.

As per the Act, except the pregnant lady is greater than 35 years of age, prenatal diagnostic strategies shall not be used or operated.

In a major ruling on girls’s reproductive rights, the apex courtroom had earlier held that every one girls are entitled to protected and authorized abortion as much as 24 weeks of being pregnant, and made any distinction on the premise of the Medical Termination of Pregnancy (MTP) Act. His marital standing is “constitutionally unstable”.
